Terms & Conditions

1. Contract and Eligibility

A contract exists only once your order has been processed and dispatched. By placing an order, you warrant that:

• You are not a minor or otherwise legally incapable of entering into a binding contract.

• All personal details provided are accurate and complete.

• You are not using a false name or unauthorised identity.

• AW Graphic Design may make changes to this website at any time without liability.
   

2. Business Hours and Communication

To maintain a high standard of service, we operate within the following hours:

• Design Hours: Monday, Tuesday, Friday, Saturday, and Sunday.

• Closed: Wednesday and Thursday every week.

• Daily Hours: 9:00am – 4:00pm.

• Communication Disclaimer: Social media posts may be scheduled to appear outside of these hours to maximize engagement. However, orders are only processed and messages are only replied to during our active business hours (9am – 4pm on working days).
   

3. Third-Party Providers and Pricing

We partner with third-party providers and printers, including Wix and Helloprint.

• Variable Pricing: These providers operate on a variable pricing structure. AW Graphic Design prices may change without prior notice to reflect these external costs.

• Price Protection: Any price formally quoted before a change is implemented will be honored for that specific project.
   

4. Payment Terms

• Orders Under £100: Payable in full at the time of booking.

• Orders Over £100: A minimum 50% non-refundable deposit is required to secure your slot.

• Final Release: High-resolution assets or website transfers will only be released once the final balance is cleared in full.
   

5. Turnaround Times

The "design clock" begins only once both the payment and all required content (logos, text, images) have been received.

• Initial Drafts: Standard turnaround is 3 to 5 working days (excluding Wednesdays and Thursdays). We reserve the right to change these times based on workload.

• Revisions: Minor revisions typically take 1 to 2 working days.

• Urgent Requests: "Rush Jobs" (24–48 hours) may be subject to an additional Express Fee.
   

6. Cancellation and Refunds

Once your order has been placed and booked in and you cancel, you will only receive 50% of your order total as a refund.

• Orders Under £100 (Paid in Full): If you cancel after work has begun, you will receive a 50% refund.

• Orders Over £100: Once work begins, the 50% deposit is strictly non-refundable.

• Post-Completion: No returns or refunds are accepted as all products are bespoke and custom-made. In the event the work is complete, you will not be entitled to a refund.
   

7. Brand Integrity and Usage

• Image Quality: To maintain the quality of our work, we ask that only original files are shared. Please refrain from using screenshots of designs.

• Watermarks: Proofs or any designs containing AW Graphic Design watermarks are not authorized for digital sharing or public display.

• Unauthorized Editing: Editing of final designs by you, any third-party app, or another designer is strictly prohibited. This includes the use of AI.

8. Design Process and Revisions

• Content Provision: Clients must provide all necessary materials within 7 days of booking.

• Revisions: Each design includes two rounds of minor revisions. Significant changes to the original brief will be billed as a new design fee.

• Proofing: Final responsibility for proofreading rests with the client. Final approval constitutes a waiver of the right to request free corrections after delivery.
   

9. Website Packages

• Managed Services: Design fees include hosting, domain registrations, and premium app subscriptions as per your specific plan.

• Third-Party Liability: AW Graphic Design is not liable for service interruptions caused by third-party platform providers (e.g., Wix, Helloprint) or any delivery delays from third-party companies such as Royal Mail, Amazon, DPD, or Helloprint.
   

10. Termination and Law

• Termination: We reserve the right to terminate any project immediately if a client is consistently delayed or behaves in an unprofessional manner without refund.

• Legal Rights: Your rights are protected by the Sale of Goods and Supply of Services Act (1980) and the Consumer Protection Act (2007).

• Severance: If any part of these terms is found unenforceable, the remaining terms shall remain valid.
   

11. Portfolio Rights

While 100% of the copyright for your design is transferred to you upon full payment, AW Graphic Design reserves the right to use these designs at any time as part of our professional portfolio and social media marketing.

• Non-Disclosure: If there are specific designs you wish not to be shared before a certain date (e.g., a secret launch), it is the responsibility of the client to advise AW Graphic Design of this in writing at any point during the design or order process.
   

12. Social Media Advertising

• Yearly Plans: Clients on our Yearly Social Media plan must ensure they provide us with a brief and any images prior to the 1st of the month where possible or with at least 3 days notice prior to your design going out to your customers.

• Weekly Plans: Clients on a weekly plan must have their content in as early as possible and must ensure all information is correct. AW Graphic Design is not responsible for collating content or ensuring its accuracy.

• Content & Third-party Copyright: Social Media clients are responsible for providing all content for marketing and must ensure they have the relevant copyright for any images provided.
   

13. Breach of Terms & Consequences

• Copyright & Usage Breach: If designs are used, shared, or edited in violation of Clause 7 (e.g., using watermarked proofs or unauthorized third-party editing), your license to use the artwork is revoked. Continued unauthorized use may result in legal action and an "Unauthorized Usage Fee" to cover damages to brand integrity.

• Non-Payment: If a final balance is not cleared within 7 days of completion, AW Graphic Design reserves the right to withhold all files, deactivate any managed website services, and pursue the debt through formal collection channels.

• Future Service: Any breach of these terms will result in the immediate and permanent termination of your eligibility for future services at AW Graphic Design.
